BuzzyBiz Survey Terms of Service

  1. Description of Terms used in this document

    1. User refers to the registered user of the application BuzzyBiz Survey.
    2. BuzzyBiz is a tradename of Sekos Technology the provider of the BuzzyBiz Survey application.
    3. Subscription refers to the Users current free or paid subscription plan.
    4. Services refer to supplied services or features of BuzzyBiz Survey.
    5. Site refers to the BuzzyBiz Survey application.

  2. Introduction

    This is an agreement between you- the “User” and Sekos Technology trading as BuzzyBiz the provider of cloud served productivity tools.

    By clicking on the “Sign Up” you or the company that you represent are consenting to be bound by and are becoming party to this agreement. Each time you use the BuzzyBiz Survey application you are agreeing to be bound by these terms.

    BuzzyBiz reserves the right, at its discretion, to modify this document or the Services supplied at any time by posting a notice on the website, or by directly contacting the User. The User shall be responsible for reviewing and becoming familiar with any such modifications. Use of BuzzyBiz Survey by the User following such notification constitutes the User's acceptance of the modified terms and conditions.

  3. Subscriptions

    Subscriptions to paid Services are available for a range of plans. Your subscription will be automatically renewed at the end of each subscription period unless you inform us that you do not wish to renew the subscription.

    The subscription fee will be charged to the Credit Card last used by you. If you would like the payment for the renewal to be made through a different Credit Card or if you do not wish to renew the subscription, you agree to inform us at least seven days prior to the renewal date.

  4. Conditions of Use

    As a condition of use, the User undertakes not to use the Services for any purpose that is unlawful or prohibited by this Agreement, or any other purpose not reasonably intended by BuzzyBiz.

    Including, but not limited to the following:

    1. to abuse, harass, threaten, impersonate or intimidate
    2. for libelous, defamatory, obscene, pornographic, abusive, or any use that violates any law or right of a third party
    3. for any illegal or unauthorized purpose that does not comply with all local laws regarding online conduct and acceptable content

    5. to post or transmit, or cause to be posted or transmitted, any communication or solicitation designed or intended to obtain password, account, or private information for unlawful purposes
    6. to modify, adapt or hack BuzzyBiz to gain intellectual property or modify another website so as to falsely imply that it is associated with BuzzyBiz
    7. the User agrees that it will not take any action that imposes, or may impose in our sole discretion an unreasonable or disproportionately large load on our infrastructure
    8. to interfere or attempt to interfere with the proper working of the Site or any activities conducted on the Site.
    9. to bypass any measures we may use to prevent or restrict access to the Site

  5. Content

    1. The User is responsible for all survey content they produce and can download a copy of their content at any time and are recommended to do so.
    2. BuzzyBiz may change, suspend or discontinue the Services including any features for any reason, at any time, including the availability of any feature, stock designs or other content. BuzzyBiz may also impose limits on certain features and services or restrict User’s access to parts or all of the Services without notice or liability.

  6. Warrantee

    • User will be solely responsible for any damage to any party resulting from surveys they create and distribute.
    • BuzzyBiz provides an OptOut link for customers of the User but the User is ultimately responsible for compliance with anti-spam and unsolicited mail legislation.
    • The Services, Content, Site and any software are provided on an "AS IS" basis, without warranties of any kind, either express or implied, including without limitation implied warranties of merchantability fitness for a particular purpose or non-infringement.
    • BuzzyBiz strives to supply the best possible quality of application and service but makes no warrantee that the services will be uninterrupted, timely, secure or virus free.
    • Use of the services of BuzzyBiz shall be at your own discretion and risk and the User will be solely responsible for any claims that result.
    • BuzzyBiz strives to provide reliable services and correct analysis, display and presentation of survey results but cannot accept liability for any consequential damages for a failure to do so.

  7. Indemnification

    The User agrees to indemnify and hold harmless BuzzyBiz, its officers, directors, employees, contractors and affiliates from and against any losses, damages, fines, and expenses including legal costs arising out of or relating to any claims that you have used the services in violation of another party’s rights in violation of any law, in violations of any provisions of the Terms or any other claim related to your use of the Services.

  8. Ownership of Survey Response Data and Analysis Results

    • The User owns all data received from responses to surveys they created and distributed and all analysis and presentations they create.
    • BuzzyBiz will not use this data for our own purposes or share this data with a third party.
    • The User can export their survey data at any time and delete some or all of their data in BuzzyBiz Survey.
